Manchester City fan GUILTY of racist gestures at United players during derby

A Manchester City fan has been convicted of making a racist monkey gesture towards Manchester United players during a derby game.

Footage and images of Anthony Burke, 42, in the crowd at the Etihad Stadium in December, 2019, were beamed around the world.

He was shown, mouth open, with both hands raised to his waist.

Giving evidence, Frank Coulson, a steward at the Etihad, told a court he saw and heard Burke shout ‘oo, oo, oo, oo’, later saying he was “100 per cent sure it was a monkey sound.”

Mr Coulson added: “I have never come across it before.

“I would say it was racism.

“I saw a gentleman, a large gentleman with a beard going ‘oo, oo, oo, oo’.

“One hundred per cent that’s what he was doing.”

Burke, a father from Painswick Road, Wythenshawe, had pleaded not guilty in August last year to a racially aggravated public order offence.

But in a trial at Tameside magistrates court on Wednesday, a judge found him guilty. He fined Burke £500 and hit him with a three-year football banning order, preventing him going to future games.

The footage and stills were shown in court.

Nick Smart, prosecuting, said tensions were high among City fans in the East Stand as United, in the 67th minute, were leading 2-0.

United players Jesse Lingard, Fred and Anthony Martial approached the stand ahead of a United corner.

Burke was sat in the front row, after borrowing a friend’s ticket to go to the game, which United won 2-1, the court was told.

French striker Martial made a ‘2-0’ gesture towards the crowd.

Burke accepted swearing and gesturing towards the players as a result, alongside many others in the crowd, but denied any racist connotation.

Mr Smart said Burke’s gesture ‘morphed into a movement’ of a monkey gesture.

“It would replicate that of a monkey shouting,” the prosecutor told the court.



He denied the offence but was found guilty

“It was caught on a television broadcast and the matter was set down to be investigated.

“Enquiries were conducted and the footage was watched.”

The court heard Burke handed himself in to police the following day. He was subsequently arrested and charged.

Etihad steward Mr Coulson said it was a ‘volatile atmosphere’ and likened it to lighting the ‘blue touch paper of a firework’.

“I stood up for the corner with my colleagues, then I heard someone shout ‘get on with it you black b******’.

“It was crystal clear.”

Mr Coulson said hearing the comment made him turn and look down the touchline, when he saw Burke’s gesture.

Coins, lighters and other missile were at the time being thrown by the crowd towards the United players, the court heard.

“I have never seen anyone do a monkey chant,” the witness added.

“The air can be blue where I work but what made this one different was that it was below the belt.

“I have never come across it myself in four years until this.”

Asked under cross examination if he misinterpreted what happened, Mr Coulson said: “It was a monkey sound.

“I am 100 per cent sure it was a monkey sound.”

Burke, giving evidence, said he was ’embarrassed by the way I reacted’.

He said it was ‘out of character’ and that he wasn’t ‘one for swearing and making hand gestures’.

Burke said the ‘whole stand’ reacted to Martial’s 2-0 gesture with ‘swear words and swearing gestures’.

He said he ‘reacted’ and made a ‘w***** sign’ at him followed by a ‘2-0 sign’.

“It was just to tell him that I was not bothered,” Burke said.

“What came out of my mouth was ‘ooooo’ – it was a continuous noise.”

He said it was designed to indicate to the player that he ‘wasn’t bothered’ or ‘scared’.

The court heard he was stood near stewards and no complaints were made, either by them or any other fan.

Mr Coulson said he alerted his manager later and was told the incident had been captured on camera.

In cross-examination, Burke said he had been drinking but wasn’t drunk.

He said he made the action back at the player to say he ‘wasn’t bothered’ and claimed the footage had ‘100 per cent been taken out of context’.

He denied making any racial gesture and said the incident had ‘destroyed my life’.

But District Judge Margaret McCormack said she didn’t find it ‘credible that you were responding to the United player in kind’.

“You were bothered,” she told Burke, finding him guilty as charged.

“Your team was being beaten. It was like a powder keg.

“You did act as alleged by Mr Coulson.”

Burke, who left court without commenting, was also ordered to pay £200 in court costs and a £50 victim levy.

Actions condemned by club and players

Burke’s actions were widely condemned by the football community following the match.

Manchester City said he would be banned for life.

Their statement, issued hours after the match in December 2019, read: “Manchester City FC are aware of a video circulating on social media which appears to show a supporter making racial gestures during the second half of the match against Manchester United this evening.

“Officials from the Club are working with Greater Manchester Police in order to help them identify any individuals concerned and assist with their enquiries.

“The Club are also working with GMP regarding an instance of objects being thrown onto the field of play.

“The Club operates a zero tolerance policy regarding discrimination of any kind, and anyone found guilty of racial abuse will be banned from the club for life.”

Manchester United players also posted to condemn Burke.

Jesse Lingard, one of his targets, tweeted: “Not even this idiot can ruin tonight’s feeling, shameful behaviour, it may be the derby but there is never ever a reason to be racist!”

And Fred told ESPN Brazil: “Unfortunately, we are still in a backward society. [It is a shame] we still have to live with that in 2019. On the field, I didn’t see anything. I saw it only in the locker room afterwards.




“The guys showed me. He even threw a lighter and it hit me. I try not to care about that. I try to look ahead.

“Unfortunately, this is happening in some stadiums. It happened here, it happened in Ukraine with some friends. It’s sad, but we have to keep our heads up and forget about that. We can’t give them any attention because that’s all they want. I spoke to the referee after the match, they will do something about it and that’s all.

“We are all the same regardless of skin color, hair and gender. We came from the same place and we all go to the same place when it’s all said and done. Thank God I have a lot of friends here in the locker room who hugged me, like Lingard. I don’t want to think about it. I just want to move on.”
